Terms of Service

1. Agreement to Terms

By accessing or using BiuWrite (the "Service") you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, you may not access or use BiuWrite. When we refer to "we", "us", or "our" we mean BiuWrite and its operating company.

2. What BiuWrite Provides

BiuWrite is a local-first writing studio for fiction authors. It combines outlining, manuscript management, AI-assisted drafting, and revision tools. Many features work offline using on-device storage. Some optional capabilities—such as syncing encrypted backups, sending email updates, or connecting third party AI providers—require an internet connection.

3. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a BiuWrite account. When you register, you agree to provide accurate information, keep your credentials secure, and notify us promptly of any unauthorized use of your account. You are responsible for all activity conducted under your login.

4. Licenses & Usage

We grant you a personal, non-transferable license to install and use the Service for your own creative projects. You may not resell, sublicense, or make the Service available to others without written permission. We reserve all rights not expressly granted here.

5. Subscriptions, Billing & Refunds

BiuWrite is currently offered as a closed beta with a one-time license that will convert to a paid plan at launch. When paid plans become available, we will clearly describe pricing, renewal intervals, and billing practices. Fees are charged by our payment processor on our behalf. Except where required by law, payments are non-refundable once access has been granted.

You are responsible for any taxes associated with your purchase. We may suspend or cancel your license if payment cannot be collected.

6. Beta Features & Feedback

Some parts of the Service may be labeled as beta, preview, or experimental. These features might change, break, or be removed at any time. We welcome feedback you choose to share and may use it to improve the product without obligation to you.

7. AI Providers & Your Content

Your manuscripts, notes, and outlines remain yours. They are stored locally unless you opt into syncing or export them. When you invoke an external AI provider, the prompts, context, and outputs are governed by that provider's terms. You are responsible for reviewing and complying with any third-party policies.

By using the Service you grant us a limited license to process your content solely to operate and improve BiuWrite—for example, to render your projects on your devices, provide backups you request, or respond to support inquiries. We do not train models on your writing without your explicit consent.

8. Acceptable Use

You agree not to:

Use the Service in violation of any law or regulation
Reverse engineer, decompile, or attempt to access source code except where permitted
Upload malicious code or disrupt the Service's infrastructure
Share license keys, login credentials, or AI provider keys with unauthorized users
Use BiuWrite to generate spam, abusive material, or content that infringes others' rights

9. Intellectual Property

The Service, including its design, code, documentation, and logos, is owned by BiuWrite or our licensors and is protected by intellectual property laws. Using the Service does not grant you rights to our trademarks or other branding.

You retain ownership of the creative works you produce with BiuWrite. We claim no rights in your manuscripts beyond the limited license described above in Section 7.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that creates risk for other users or for us. Upon termination, your license to use the software ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will remain in effect.

11. Disclaimers

BiuWrite is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or secure, nor do we guarantee that AI-generated suggestions will be accurate or appropriate for your creative project. To the fullest extent permitted by law we disclaim all warranties, whether express or implied.

12. Limitation of Liability

In no event will BiuWrite, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.

13. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in King County, Washington for any dispute arising out of these Terms or the Service.

14. Changes to These Terms

We may update these Terms to reflect new features, regulatory requirements, or business practices. When we make material changes we will update the date at the top of this page and notify you via email or in-app messaging. Continued use after changes become effective constitutes acceptance of the revised Terms.
